Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Wiggle Room scheduling application and website (the "Services") provided by Honey & Jam Ventures Ltd. ("Wiggle Room," "we," "us," or "our"). By creating an account or using the Services, you agree to be bound by these Terms.

Account Registration

To use the Services, you must create an account through our authentication provider (Clerk). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep it up to date.

Free Trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start your trial. At the end of the trial period, you will need to subscribe to a paid plan to continue using the Services.

Subscriptions and Billing

Wiggle Room offers monthly and annual subscription plans. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

• Monthly plans are billed at the start of each billing cycle.
• Annual plans are billed once per year at a discounted rate.
• You may switch between plans or cancel at any time from your account settings.
• Refunds are not provided for partial billing periods, but you will retain access until the end of your current period.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Services until the end of your current billing period. After that, your account will be paused and your data will be retained for 30 days, during which you may reactivate your account or export your data.

Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Services or its related systems
• Interfere with or disrupt the integrity or performance of the Services
• Reverse-engineer, decompile, or disassemble any aspect of the Services
• Use automated scripts, bots, or crawlers to access the Services without our prior written consent

Your Data

You retain ownership of all data you enter into the Services, including client information, project details, schedule entries, and rate information. We do not claim any intellectual property rights over your data.

You grant us a limited license to store, process, and display your data solely for the purpose of providing the Services. For details on how we handle your data, please see our Privacy Policy.

Service Availability

We strive to keep the Services available at all times but cannot guarantee uninterrupted access. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service downtime.

Intellectual Property

The Services, including all software, design, text, graphics, and other content (excluding your data), are owned by Honey & Jam Ventures Ltd. and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Services without our prior written consent.

Limitation of Liability

To the fullest extent permitted by law, Wiggle Room and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by updating the "Last updated" date at the top of this page. If we make material changes, we will notify you by email or through the Services. Continued use of the Services after changes indicates acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
